Finer Capital · Stamp Duty Land Tax
A specialist review of what you paid, what the law says, and whether HMRC owes you money. If the answer is no, we tell you so.
Five questions
On completion day, was part of the property already let, licensed or used by an unconnected business, such as a farmer, grazier, shop or surgery?
Did the contract, title or replies to enquiries refer to that arrangement?
Is that part physically separate from the house and garden, with its own access or boundary?
Was the business use set up by you, or by a business connected to you or your adviser, at or after completion?
Is the non-residential part only paddocks for your own animals, a home office or a garden building?
A first sift, not advice. It shows whether your purchase has the features that succeed at tribunal.

The refund is only recoverable if the property genuinely included a non-residential element at completion. Use the five questions above before assuming any of it is yours.

Questions clients ask
An amended return is the cleanest route and must reach HMRC within 12 months of the filing date, which is 14 days after completion. After that, an overpayment relief claim may be possible up to four years after completion, but the grounds are narrower.
No. The law looks at what you bought on completion day. A lease or licence you grant afterwards, or on the day itself, does not change that, and relying on one is the fastest way into an HMRC enquiry.
We agree the fee in writing after the verdict stage. We do not take on cases we would not defend in front of HMRC, whatever the fee basis.
No. We provide tax advisory services. Where a matter needs a solicitor or barrister, for example a tribunal appeal, we will say so and work alongside them.
No. Scotland has Land and Buildings Transaction Tax and Wales has Land Transaction Tax, each with its own rules. This page covers England and Northern Ireland.
